In a 6-1 majority decision on Monday, the Supreme Court removed the permanent disqualification of legislators under Article 62(1)(f) of the Constitution, declaring that the legislation would only prohibit them from holding office for a five-year period. In the Samiullah Baloch case, the supreme court overturned its 2018 ruling that the disqualification imposed under Article 62(1)(f) was intended to be “permanent.” The same article 62(1)(f) that disqualified former prime minister Nawaz Sharif in the Panama Papers case also establishes the requirement for a member of parliament to be “sadiq and ameen” (honest and righteous). The identical clause also disqualified Jahangir Tareen, the leader of Istehkam-i-Pakistan. Nawaz and Tareen are now both eligible to run for office in the wake of today’s ruling.
