On Tuesday, the Judicial Commission of Pakistan (JCP) has established a seven-member constitutional bench headed by Justice Amin-ud-Din Khan in response to the 26th Amendment, which was ratified by parliament last month.
A majority of the members voted in favour of the constitutional bench, which was formed by a 7-5 split decision by the Chief Justice of Pakistan (CJP) Yahya Afridi-led judicial panel.
According to sources, the ruling was opposed by CJP Afridi, the seniormost justices, Justices Mansoor Ali Shah and Muneeb Akhtar, as well as opposition PTI members Omar Ayub and Shibli Faraz.
Judges from every province are represented on the constitutional bench: Justices Amin-ud-Din and Ayesha Malik from Punjab, Muhammad Mazhar and Hassan Azhar from Sindh, Justice Jamal and Naeem Afghan from Balochistan, and Justice Musarrat Hilali from KP.
