Notification on phone tapping by ISI challenged in LHC

The Lahore High Court (LHC) has heard a petition against the federal government’s notification permitting the Inter-Services Intelligence (ISI) to tap and intercept people’ phone calls.
Through Attorney Nadeem Sarwar, citizen Fahad Shabbir filed a case at the LHC contesting the notification, designating the prime minister, the federal government, and the Pakistan Telecommunication Authority (PTA) as respondents.

According to the appeal, the Pakistani government has issued a notification under Section 54 of the PTA Act 1996 that permits ISI to tap citizens’ phones, but no guidelines have been developed for the notification’s issuance.
The petitioner argues that persons have the right to privacy and free speech under the constitution. And the Indian Supreme Court says that tapping someone’s phone is an obvious breach of the constitution, he claims.

The petitioner requests the court to declare the government notification of intercepting and recording calls and messages by ISI or other agencies illegal and annual the notification until final verdict on the plea.
He also pleads that the court direct the government to devise rules of PTA Act Section 54.
