Justice Athar Minallah of the Supreme Court stated on Tuesday that it is a “proven fact” that the Election Commission of Pakistan (ECP) misconstrued the ruling of the high court, which disallowed the Pakistan Tehreek-e-Insaf (PTI) from using its “bat” emblem due to the party’s inability to conduct legitimate intra-party polls.
“Should the court uphold an unlawful interpretation made by a body established by the Constitution? Do you favour bringing back the necessity doctrine?” Justice Minallah said anything.
His comments coincided with the Sunni Ittehad Council’s (SIC) appeal against the Peshawar High Court’s (PHC) ruling that upheld the Election Commission of Pakistan’s (ECP) decision to deny them the reserved seats being heard by a 13-member full-court SC bench.
